1. Acceptance of Terms

By accessing or using Swim Lane 4 ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform.

If you are using the Platform on behalf of an organization (such as a swim team or club), you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Swim Lane 4 is a swim team records and analytics platform that provides:

• Swimming performance tracking and records management
• Personal best tracking and goal setting
• Team records and statistics
• Import and management of swim meet results
• Social features including activity feeds and notifications

3. Account Registration

3.1 Eligibility

• You must be at least 13 years old to create an account directly
• Children under 13 may only use the Platform through a parent-managed account with verified parental consent (see our Privacy Policy for COPPA compliance details)

3.2 Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials
• You must provide accurate and complete information when creating your account
• You must notify us immediately of any unauthorized use of your account
• You are responsible for all activities that occur under your account

4. User Conduct

When using the Platform, you agree NOT to:

• Violate any applicable laws or regulations
• Impersonate another person or entity
• Upload false, misleading, or fraudulent swim times or data
• Harass, abuse, or threaten other users
• Attempt to gain unauthorized access to the Platform or other users' accounts
• Use automated tools to scrape or collect data without permission
• Interfere with the proper functioning of the Platform
• Upload malware, viruses, or other harmful content

5. Content and Data

5.1 Your Content

You retain ownership of content you upload to the Platform (such as swim times, goals, and profile information). By uploading content, you grant us a license to use, store, and display that content as necessary to provide our services.

5.2 Data Accuracy

While we strive to maintain accurate swimming data, we do not guarantee the accuracy of any swim times, records, or statistics displayed on the Platform. Official times should be verified through official meet results.

5.3 Team Data

Team administrators are responsible for the accuracy of data they import and the management of their team's information. Teams may set their own visibility preferences for records and swimmer data.

6. Privacy

Your use of the Platform is subject to our Privacy Policy, which describes how we collect, use, and protect your information.

7. Intellectual Property

The Platform and its original content, features, and functionality are owned by Swim Lane 4 and are protected by copyright, trademark, and other intellectual property laws.

The Swim Lane 4 name, logo, and related marks are trademarks of Swim Lane 4. You may not use these marks without our prior written permission.

8. Subscriptions and Payments

8.1 Free Tier

We offer a free tier with access to core features. Free accounts may have limitations on historical data access (e.g., 2-year swim history limit).

8.2 Paid Subscriptions

Teams may subscribe to paid plans for additional features. Subscription terms, pricing, and payment terms will be presented at the time of purchase.

8.3 Refunds

Refund policies for paid subscriptions will be specified at the time of purchase. Generally, subscriptions are non-refundable except as required by law.

9. Third-Party Services

The Platform may integrate with third-party services (such as USA Swimming for meet results). Your use of these services is subject to their respective terms and policies.

10. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

WE ARE NOT RESPONSIBLE FOR ANY DECISIONS MADE BASED ON DATA DISPLAYED ON THE PLATFORM, INCLUDING TRAINING DECISIONS, TEAM SELECTIONS, OR COMPETITION ENTRIES.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWIM LANE 4 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Swim Lane 4 and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform or violation of these Terms.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time through your account settings.

Upon termination, your right to use the Platform will immediately cease. Provisions of these Terms that by their nature should survive termination will survive.

14. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
